The MOJ Mandate

Mandate of the Ministry of Justice and Religious Affairs

  1. The President Decree No 2 of 31/03/1999 that established the Ministry of Justice and Religious Affairs of the Punt-land state laid down its main mandate and functions. As stipulated in the above Decree the Ministry had the following mandates and functions: 
    • Systematize and plan the policies and administration of the Ministry.

     

    • Promote respect for rights and freedoms, the rule of law and the Constitution

     

    • Promote an awareness of individual responsibilities and civil obligations.
    • Coordinating, advising on, providing support and developing working modules for the formulation and implementation of policies, which will foster the effective administration of law and justice as well as constitutional governance;

     

    • Representative the Government (Executive) of all political, endowments, administrative and transmission to the President of Decrees for the nomination of Judges.

     

    • Controlling legal practice in the country

     

    • 5Disseminating legal information to the public

     

    • Liasing and working with institutions which seek to eradicate corruption

     

     

    • Promoting legal advice of the constitution

     

    • Advising the government and its allied institutions on all legal matters.

     

    • Supervise and monitor justice sector stake holders

     

    • Protecting the Constitutional Rights of citizens and other residents

     

    • Ensuring the independence of the judiciary

     

    • Reinforcing confidence in Legal Institutions

     

    • Carrying out law reform to effect greater social justice

     

    • Carrying out legal directives by the courts for the protection of society

     

    • Maintain the supremacy and other laws promulgated by the Government.

     

    • Improve religious affairs and contribute to national development through human resource

     

    • Supervise and make use of the Islamic Sharia.

     

    • Encourage and propagate the Islamic religion

     

    • Arrange Islamic Scholars for orientation and propagation of the Islamic religion

     

    • Take care of and gather statistics on mosques, charities/endowments and Koranic Schools.

     

    • Get solutions for potential differences of opinions and arguments over doctrines of the Islamic religion.

     

    • Ensure that the Zakat is paid in accordance to the Islamic Sharia.

     

    • Regulate the by-laws that deal with public misbehavior.

     

    • Supervise and manage the prisons.

     

    • Register and certify agreements on transfer of private property.

     

    • Attend international conferences on Hajj (Pilgrimage) and meetings of Islamic governments and Institutions.
